No justification for a Citizen’s arrest

This seems to be the best take on the Arbery case:

Other lawyers who have been following the case argue that since a police officer who knew everything that Travis McMichael did could have legitimately made an arrest of Abrery (no one is arguing that he wasn’t the burglar anymore), McMichael could have made the arrest as well. I don’t buy that, because McMichael was not a police officer. He isn’t deputized by the state to do that sort of thing, and there was no extreme circumstance like in the Rittenhouse case where people were trying to defend businesses from arson in the absence of police authority.

Some observes have said the defense attorneys are competent and the prosecutor isn’t. Will be interesting to see how it turns out. McMichael is probably morally culpable for the death, but could well get off.

I know. I was drawing attention to it.

  2. If you could stop any passer by based on “suspicion” the world would be chaos.
